The petitioner is apprehending his arrest in connection with offence punishable under Sections 342, 307/34 IPC and 27 of Arms Act.
It has been submitted on behalf of the petitioner that though there is allegation against the petitioner and others is of indiscriminate firing, none has received injury. It has been further submitted that as a matter of fact prior to the present case the father of .the petitioner has filed a case against the informant for kidnapping of his daughter, which is still pending and the informant has criminal antecedent.
Heard learned A.P.P. also.
In view of the facts, as stated above, let, above
Patna High Court Cr.Misc. No.14834 of 2017 (2) dt.04-04-2017 2/2 named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, Patna, in Barh P.S.Case No. 284 of 2016, subject to the conditions as laid down u/s 438(2) Cr.P.C. and further conditions that the petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioner will not induce any witness or tamper with the evidence.
