The application is for grant of bail in connection with Chowk PS case no. 156 of 2016 for the offence under Sections 272, 273 of the Indian Penal Code and 47(a), 54, 57, 60 of Excise Act.

It is submitted on behalf of petitioner that allegation against her is that there is recovery of 16 bottles of foreign liquor from her possession, however, she is a lady and remain in custody for about 05 months.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Having heard both sides. It appears from

Patna High Court Cr.Misc. No.43894 of 2016 (3) dt.20-01-2017 2/2 petitioner is a lady and remain in custody for about 05 months and she has no criminal antecedent. As such, the bail application of petitioner is allowed and she is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sushant Ranjan, Judicial Magistrate 1st class, Patna City (Patna) in connection with Chowk P.S. case no. 156 of 2016 with a condition that bailors should have the property within the jurisdiction of learned court below with further condition that she will cooperate in the disposal of the case and petitioner shall make herself available on each and every date except on some genuine reason.
