Sri Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-11-2018 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Barun P.S. Case No. 17 of 2016 instituted for the offence under Section(s) 25(1-B)a, 26, 27, 35 of the Arms Act. In the written report, it is alleged that police got information about committing robbery in petrol pump. Police reached the place of occurrence and found one person lying in wounded condition. On interrogation from the Manager of the petrol pump, police learnt that this wounded person along with three other persons have committed robbery at the petrol pump. It is further alleged that the person who was apprehended had disclosed his name as Sunil Ram ( petitioner ) and, on search, two live cartridges have been recovered from his possession

Patna High Court Cr.Misc. No.68131 of 2018(2) dt.26-11-2018 2/2 and one fired cartridge and pistol have been seized from the bag which was lying near this petitioner. This petitioner further disclosed to the informant that three of his associates, namely, Manjit Singh, Chhotu Ram and Awadh Ram had fled away from the place of occurrence after making firing. Learned counsel for the petitioner has submitted that case is pending for framing of charge in the court below. Petitioner is in custody since 3.2.2016.

Keeping in view the period of custody already spent by the petitioner and charge has even not been framed till date, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Aurangabad in connection with Barun P.S. Case No. 17 of 2016, Trial no. 830 of 2016 ,subject to the condition that both the bailers shall be the close relative of the petitioner.
