Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in Samastipur Town P.S. Case No. 192 of 2021 registered for the offence under Sections 188, 353, 406, 506/34 of the Indian Penal Code. Prosecution case in short is that some government work was sanctioned to the petitioner which was not completed within the stipulated time. The petitioner is alleged to have offered bribe to the informant and on refusal, threatened to get him transferred. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. As per allegation, the petitioner is said to have offered bribe to the informant

Patna High Court CR. MISC. No.21439 of 2022(2) dt.06-05-2022 2/2 and on refusal, threatened to get transferred him. It has been submitted on behalf of the petitioner that for political reason, the petitioner has been made accused in the present case. Neither the bribe had been offered nor any threatening of his transfer was given to the informant.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Samastipur Town P.S. Case No. 192 of 2021 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
