====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 27-01-2021 Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a) and 36 of the Bihar Prohibition and Excise Act.

Petitioner is in custody since 02.03.2020.

Allegation is that the petitioner and two others fled away leaving the liquor which was recovered by the authorities. Petitioner has got more than one case registered under Excise Act.

Considering the period already undergone and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty

Patna High Court CR. MISC. No.19741 of 2020(5) dt.27-01-2021 2/2 thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ahiyapur P.S. Case No. 61 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) If the court below would come to notice that the petitioner has committed identical offence after release on bail that would be a ground for cancellation of bail of the petitioner by the court below itself.
