2. In the present case, the petitioners seek bail in connection with Rivilganj P.S. Case No. 226 of 2024 dated 27.07.2024, registered for the offence punishable under Section 309(4) of the BNS.
3. As per the prosecution case, three persons, riding a motorcycle, on gunpoint snatched the mobile phone of the informant, Rs. 13,256/- and keys of the motorcycle. The name of the petitioners transpired during investigation for being involved in the said robbery.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.20724 of 2025(4) dt.20-08-2025 2/3 petitioners submits that petitioners are innocent and they have falsely been implicated in the present case. The petitioners were apprehended in some other cases and have been remanded in this case which has been registered against unknown. He further submits that nothing incriminating has been recovered from person or possession of the petitioners and they have not been put to any test identification parade. The petitioners have been made accused in this case only due to their criminal antecedents. Learned counsel next submits that petitioner no. 1 is having 7 criminal antecedents and petitioner no. 2 is having 6 criminal antecedents and chargesheet has been submitted. Learned counsel lastly submits that petitioners are in custody since 18.09.2024.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody and submission of chargesheet, the petitioners, above-named, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra /
Patna High Court CR. MISC. No.20724 of 2025(4) dt.20-08-2025 3/3 concerned Court, in connection with Rivilganj P.S. Case No. 226 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioners on single date or in violation of the terms of the bail, the bail bonds of the petitioners will be liable to be cancelled by the Court concerned.
