JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The petitioner is apprehending his arrest in connection with Complaint Case No. 1911C of 2015, registered for offences punishable under Sections 323/498A Indian Penal Code and Section 3/4 of Dowry Prohibition Act.
Learned counsel for the petitioner submitted that he is still ready to keep his wife (complainant) with full honour and dignity and he has also filed a case for restitution of conjugal rights before the Principle Judge, family court, Bokaro. Heard learned A.P.P. also.
In view of the submissions of learned counsel for the petitioner that he is still ready to keep the complainant with full
Patna High Court Cr.Misc. No.12554 of 2017 (2) dt.29-03-2017 2/2 honour and dignity, let petitioner surrender before the Court below on 12.04.2017 on which date opposite party no. 2-complainant shall also present herself and the court below shall watch the conduct of the petitioner and if it is found that he is ready to keep his wife with full honour and dignity, shall enlarge the petitioner on provisional bail to his satisfaction for a period of six months, during which period the petitioner and the complainant shall have to appear in the court below on each month on the date fixed by the court below and the court below only after satisfying himself with the conduct of the petitioner and also after satisfying himself with the status of matrimonial life of the parties, shall confirm the provisional bail of the petitioner, otherwise, he is free to pass any order as he deems fit and proper.
It is needless to say if opposite party no. 2 does not appear before the court below on the above mentioned date, the court below shall enlarge the petitioner on bail. With the above observation, this application is disposed of.
