The petitioner seeks bail in Khusrupur P.S. Case No. 35 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act.

It is alleged in the written report that informant during course of patrolling duty, got secret information by Chaukidar Ganauri Paswan that some persons are selling liquor. He along with Police personnel reached the place of occurrence. On seeing the Police party, petitioner and other accused persons started running away leaving plastic bags and bucket. The accused persons managed to run away. The Chowkidar identified the petitioner and other accused persons. It is further alleged that on search, 106 polythene, each

Patna High Court CR. MISC. No.20170 of 2019(2) dt.02-04-2019 2/2 containing 200 ml. of country made liquor kept in the plastic bag has been recovered.

Petitioner is in custody since 14.2.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna, in connection with Khusrupur P.S.
