JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks bail in connection with Lalganj P.S.Case No. 90 of 2018 registered under Sections 399, 402 and 414 of the Indian Penal Code and 25(1-b)a/26.35 of the Arms Act.

Allegation, as per the FIR, is that police on information raided the place and arrested the petitioner and other co-accused persons and from petitioner there is recovery of one country made pistol with cartridges and also there is recovery of from other accused persons and it further appears that at the instance of accused persons, one stolen pick-up van has been recovered. Submission of learned counsel for the petitioner is that petitioner has no criminal antecedent and he is in custody for more than 08 months.

No.74747 of 2018(2) dt.17-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with direction to the court below to verify the criminal antecedent of the petitioner and if it is found that he has no criminal antecedent, the court below shall release the petitioner on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned court below in connection with Lalganj P.S. Case No. 90 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
