JUSTICE BIBEK CHAUDHURI ORAL ORDER 15-05-2026 Cr.WJC No. 288 of 2023 was filed for a direction upon the police authorities to take fresh evidence annexed with the writ petition and to investigate into the matter further, and if fresh materials come up, to file a supplementary charge-sheet against the accused persons. Paragraph 34 of the writ petition contains detailed instruction passed by this Court in this regard. Alleging non-compliance of the said order, the instant contempt application has been filed.

2. The Opposite Parties have filed a show-cause

Patna High Court MJC No.818 of 2026(4) dt.15-05-2026 2/3 against the contempt application, stating, inter alia, that a superior police officer in the rank of Deputy Superintendent of Police was engaged for further investigation of this case. The copy of the writ petition was supplied to him. He went through the annexure to the writ petition but did not find any fresh material to cause any further investigation or to file a supplementary charge-sheet. He submitted a report to the Superintendent of Police, Vigilance Investigation Bureau, Bihar, Patna. The said report is made Annexure-C.

3. The learned Advocate on behalf of the petitioner submits that the Investigating Officer did not even examine the writ petitioner.

4. Since, the Investigating Officer did not find any fresh material, this Court cannot make any direction to the investigating agencies regarding the course of investigation. Therefore, the contempt application is dropped.

5. However, from the report, it is found that on 08th January, 2025, the writ petitioner was examined by the I.O., and the I.O. requested him to supply any fresh material against the accused persons, but the writ petitioner submitted that, except the documents annexed with the writ petition, he had no other document to submit before the I.O.

6. Considering such circumstance, further examination of the writ petitioner is not necessary. However, the disposal of the contempt petition does not debar the petitioner to file fresh writ petition or any other legal proceeding challenging the Report submitted by the I.O.
