The petitioner is apprehending his arrest in connection with Deo P.S.Case No.43 of 2016 registered for offences punishable under Sections 420, 406, 402 and 34 of the Indian Penal Code. It is submitted on behalf of the petitioner that by a common letter, it is alleged, the petitioner has defalcated sum of Rs.5,20,000/-, which has been allotted for the purpose of construction of the building of the School. It is further submitted that as per Annexure-2, the construction work has been completed and the same has been informed by the Programming Officer to the Block Education Officer and rest of the amount was left with the petitioner and the same has been deposited in the Account as such the petitioner deserves anticipatory bail.

Having heard both sides and in view of Annexure-2 as well as the petitioner is lady, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Deo P.S.Case No.43 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

With further condition that the petitioner shall co-operate in the investigation of the case and will make available the documents before the Police and appear also as and when required and she will also show Annexure-2 to the Investigating Officer and further condition that if there are some serious incriminatory materials comes against the petitioner, the prosecution is free to move for cancellation of her bail bonds.
