Heard learned counsel for the parties.

Petitioner is an accused in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Informant alleges that his daughter was always being subjected to cruelty for fetching dowry by her husband Pappu Paswan and his family members. Meanwhile, Pappu Paswan developed illicit relation with the petitioner. On 4.8.2017 informant received information that his daughter has been killed by the accused persons.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case as she is no way concerned with the family of the deceased. Petitioner

Patna High Court CR. MISC. No.19975 of 2020(2) dt.30-06-2020 2/2 has been implicated in this case due to local village politics and there is no direct allegation against her. Petitioner has got no criminal antecedent and she is in custody since 18.1.2020. Charge sheet has also been filed in the case. Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur in Naubatpur Police Station Case No. 233/2017, on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on her absence on two consecutive dates without sufficient reason, her bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
