Petitioner is an accused in a case registered for offence punishable under Section 302/34 of I.P.C. Prosecution case is that this petitioner along with his family members subjected the deceased to the cruelty for dowry and when his demand was not fulfilled the deceased had been strangulated by accused persons.

It is submitted on behalf of the petitioner that he has falsely been implicated in this case. From the allegation made in the FIR it is apparent that there was no demand of dowry and the petitioner has been implicated in this case only due to being husband of the deceased.

Counsel for the State opposes the prayer for bail. He submits that there is allegation against the petitioner that he in

Patna High Court CR. MISC. No.19973 of 2020(2) dt.30-06-2020 2/2 collusion with his family members strangulated the deceased. Even Post Mortem report also corroborates the prosecution case. In view of the nature of allegation against the petitioner, I am not inclined to grant him bail. The same is rejected with direction to the petitioner to surrender and seek regular bail within six weeks from the date of receipt of this order it would be considered on its own merit without prejudice.
