In the present case, the petitioner is seeking bail in Excise Case No.279 of 2020 arising out of Kudra P.S. Case No. 87 of 2020 registered for the offence punishable under Section 414 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2018. The police has recovered about 77.760 liters of illegal liquor from a car and one co-accused Umesh Kumar Yadav was arrested from the spot, who disclosed the name of the petitioner, however, it is urged that nothing has been recovered from the possession of the petitioner and he is in judicial custody since 23.03.2020.
Considering the facts and circumstances of the case,
Patna High Court CR. MISC. No.21017 of 2020(2) dt.30-06-2020 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Kaimur at Bhabua in connection with Excise Case No. 279 of 2020 arising out of Kudra P.S. Case No. 87 of 2020 with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
