JUSTICE RAJESH KUMAR VERMA ORAL ORDER 25-04-2025 Heard Mr. Rajive Ranjan Singh, learned counsel for the petitioner and Mr. Pramod Kumar Pandey, learned Additional Public Prosecutor for the State.
2. Petitioner seeks bail in connection with Sangrampur P.S. Case No. 144 of 2024, F.I.R. dated 15.07.2024 for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.
3. According to prosecution case, all the accused persons including the petitioner abused the informant and on protest, one co-accused person brought iron rod and gave it to the petitioner and assaulted the informant result of which the informant sustained injuries on his nose.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent has falsely been implicated in
Patna High Court CR. MISC. No.20730 of 2025(3) dt.25-04-2025 2/3 the present case. The allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as allged in the F.I.R. From the perusal of the F.I.R., it appears that the date of occurrence is 19.06.2024 but the present F.I.R. has been instituted on 15.07.2024 after delay of about 25 days without giving any explaination of delay. Apart from that, it appears from that from the perusal of the F.I.R. it appears that there is specific allegation of assault is attributed against the petitioner and the injured person had received injury and the coaccused person, namely, Sandip Kumar has been granted the privilege of anticipatory bail vide order dated 08.01.2025 in Cr. Misc. No. 88268 of 2024 by this Court.
5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts that the petitioner has clean antecedent and the co-accused person has been granted the privilege of anticipatory bail by this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Sangrampur P.S. Case No. 144 of 2024, subject to the following conditions:-
Patna High Court CR. MISC. No.20730 of 2025(3) dt.25-04-2025 3/3 i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
