The petitioner seeks bail in S.T. No. 597 of 2017 (arising out of Siwan Town Police Station Case No. 345 of 2017, registered for the offences punishable under Sections 147, 148, 149, 302 and 120(B) of the Indian Penal Code. This is the second attempt of the petitioner for his release on bail in connection with case as noted above. Learned Counsel, appearing on behalf of the petitioner, submits that three other co-accused persons similarly circumstanced, have been granted regular bail by this Court and, therefore, the petitioner deserves similar treatment. He also contends that there is no eye witness to the occurrence. The petitioner is in custody since 17.07.2017.

No.66571 of 2018(2) dt.03-12-2018 2/2 From perusal of the first information report, I find substance in the submission made on behalf of the petitioner that this case is similarly circumstanced with that of co-accused Vijay Kumar Gupta, who has been granted bail. Considering the above submission, this application is allowed.

Let the petitioner, Rohit Kumar @ Mahabir, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Additional District & Sessions Judge IV, Siwan in S.T. No. 597 of 2017 (arising out of Siwan Town P.S. Case No. 345 of 2017).
