The petitioner apprehends his arrest in connection with Akbarpur P.S.Case No.158 of 2015 registered for an offence under Sections 147, 148, 149, 384, 354(B), 504 and 506 of the IPC and Section 27 of the Arms Act.

This case has been registered on the basis of complaint petition. The complainant has alleged that on the date of occurrence, this petitioner and his family members allegedly entered into her house and assaulted and abused her. Learned counsel for the petitioner submits that both are resident of same place and in course of construction of a house they came to forbade her from construction work. Patna High Court Cr.Misc. No.13187 of 2017 (2) dt.29-03-2017 2/2 committed overt-act for which the petitioner has filed Complaint Case No.6259 of 2015. The allegation levelled against the petitioner is omnibus and only with a view to make the offence graver.

However, learned APP opposed the submissions. Considering the omnibus allegation, case and counter case between the parties and also the fact that both are neighbours, let the above named petitioner in the event of his arrest or surrender in the court below be admitted on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-I, Nawada in connection with Akbarpur P.S.Case No.158 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
