JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-08-2023 The present writ petition has been filed seeking the following reliefs:- "1.(I) For commanding the state respondents to make payment of dues amount E.P.F. (Employee Provident Fund) from 2005 to 2009 with statutory interest to the petitioner.
(II) Also to revised the salary of the petitioner in view of 6th pay revision w.e.f. July 2007 and fixed the pension on revised salary.
(III) Also for directing to state respondents to pay arrear of difference of salary and difference of pension in view of 6th pay revision with statutory interest.
Patna High Court CWJC No.20612 of 2014(2) dt.16-08-2023 2/2 (IV) Also to provide calculation chart to the petitioner.
(V) Also for any other relief/reliefs for which petitioner is entitled in the eyes of law."
At the outset, the learned counsel for the petitioner has informed this Court that except the outstanding dues of Employees' Provident Fund for the period 2005 to 2009, the rest amount of outstanding dues have already stood paid to the petitioner, hence the Assistant Commissioner, Employees Provident Fund, (R) Block, Patna, be directed to make payment of the outstanding dues of Employees' Provident Fund for the period 2005 to 2009. It is directed accordingly. It is needless to stated that in case the outstanding dues of Employees' Provident Fund of the petitioner are not paid within a period of four weeks from today, the Regional Employees' Provident Fund Commissioner, Patna and the Assistant Commissioner, Employees Provident Fund, R-Block, Patna, shall not draw their salary.
The present writ petition stands disposed off on the aforesaid terms.
