JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-12-2020 Heard the parties through the virtual court proceeding. The petitioner apprehends his arrest in connection with Chainpur P.S. Case No. 133 of 2016, Registration No.1546 of 2016 registered for the offences punishable under Sections 341, 323, 498-A/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
The informant namely Chandani Devi Sandhya Devi has lodged a criminal case and has alleged in the written report that her marriage was solemnized with Jaideep Jaiswal on 28.11.2010 and after marriage, she went her sasural. After one month, accused persons demanded one Bolero vehicle and started tortured her. The informant further alleged that her father
Patna High Court CR. MISC. No.24214 of 2020(4) dt.03-12-2020 2/3 gave money to the accused persons as Rs.2,00,000/- and the Bolero vehicle was purchased. She has stated that character of the father-in-law was not good and he has attempted to illicit relation. The informant further alleged that on 04.11.2011, one baby was born and she is aged about 4 years. Informant further alleged that accused persons were demanded for two lakh in the name of Amrita (daughter) and on 10k.05.2016, the accused persons have leaved to the informant near the Hata Market and she come at the parental house. The informant alleged that her father and other relatives went for settled the matter, but they have denied for keeping the informant.
Learned counsel for the petitioner submits that the petitioner is the father-in-law of the informant and living separately from the husband of the informant. The petitioner is aged about 85 years old and as such allegation in the F.I.R. is false and concocted.
In the facts and circumstances of the case, petitioner is the father-in-law of the informant. Let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the
