JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Obra P.S. Case No. 533/2022, registered for the offence punishable under Sections 341, 323, 504, 379, 354, 307, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner is not named in the F.I.R. Petitioner and informant are own gotiya and land dispute is going on between the parties. Petitioner is in custody since 03.01.2023.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.22773 of 2023(2) dt.17-05-2023 2/2 the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of S.D.J.M., Daudnagar, Aurangabad in connection with Obra P.S. Case No. 533/2022.
