JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
Informant's motorcycle was robbed leading to registration of F.I.R against unknown. During investigation the cousin of the petitioner Santosh Yadav was apprehended who suggested the name of the petitioner.
It is submitted by learned counsel for the petitioner that Santosh Yadav has serious criminal antecedent which is being protested by the petitioner, as a result the petitioner has been named by his cousin. Moreover there is no recovery from the possession of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner
Patna High Court Cr.Misc. No.40051 of 2015 (2) dt.06-10-2015 2/2 surrenders within a period of six weeks in connection with Pratapganj P.S. Case No. 06 of 2015, pending in the Court of learned Judicial Magistrate, Birpur, Supaul.
With the observations above, the application stands disposed off.
