The petitioner seeks bail in connection with Muffasil (Lakhaura) P.S. Case No. 58 of 1990 instituted for the offence under Section(s) 366/366(A)/376 of the Indian Penal Code. This is a case of misuse of privilege of bail. From the impugned order it appears that petitioner was declared absconder on 30.8.2003. Petitioner is in custody since 8.3.18.
Learned counsel for petitioner submits that now charge has also been framed against petitioner on 27.6.2018 in the court below, which also finds mentioned in the impugned order. This is a case registered for the offence under Sections
Patna High Court Cr.Misc. No.71957 of 2018(3) dt.13-12-2018 2/2 366, 366A and 376 of the IPC.
The petitioner has sufficiently been punished for the laches on his part.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge, East Champaran at Motihari in connection with Sessions Trial No. 296 of 2018 arising out of Muffasil (Lakhaura) P.S. Case No. 58 of 1990, subject to the condition that both the bailers shall be the close relative of the petitioner with further conditions that :
(1) The petitioner will remain present on each and every date of case.
(ii) Absence of petitioner on two consecutive dates without valid reason will amount to cancellation of his bail bond. (iii) The petitioner will not try to tamper with evidence during the trial.
