The petitioner is languishing in custody since 20.11.2018 in a case registered for the offences punishable under Sections 406 and 420 of the IPC.

The prosecution case is that the petitioner, being a police constable and bodyguard of S.P., Gaya realized Rs. 2 lacs from the informant for providing employment to his son in the police force, but neither the money was returned, nor the son of the informant was provided employment.

It is submitted by learned counsel for the petitioner that there is no proof with regard to payment of the money to the petitioner and the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that

Considering the fact that the investigation has been concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Nalanda in connection with Rajgir P.S. Case No. 346 of 2018.
