Let the defects, if any, be removed within fifteen days of the start of the physical Court.

Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner allegedly fired causing injury at the abdomen of the informant. The Doctor has found consistent injury caused by firearm.

Learned counsel for the petitioner submits that there is case and counter case. Petitioner also sustained injury during the

Patna High Court CR. MISC. No.19745 of 2020(3) dt.02-09-2020 2/2 occurrence. He is in custody since last seven months. Investigation of the case is already complete against the petitioner.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Madhepura P.S. Case No. 189 of 2020 pending in the Court of learned Chief Judicial Magistrate, Madhepura.

Hence, prayer for bail is refused.

However, the petitioner may renew his prayer for bail if the trial is not concluded within a period of nine months from the date of receipt/production of a copy of this order. Learned Trial Judge is directed to expedite the trial and conclude the same.
