Mr. Mohammed Arif, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 504, 323, 325, 307, 354, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 10.12.2021 at 7:00 am, all the accused persons, including the petitioner, came variously armed and started abusing her and when she protested, Asok Yadav assaulted by farsa causing injury on her head and Surendra Yadav tore her blouse and made her semi-naked, further all the accused persons assaulted her and when her husband intervened to save her, he was assaulted by Surendra Yadav by garasa causing injury on

It is further alleged that on alarm people started gathering when Neelam Devi and Raghubir Yadav snatched golden chain from her neck and took away Rs. 40,000/-. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from perusal of the allegations as alleged in the FIR it would manifest that the allegation of assault is specific and as far as this petitioner is concerned, the allegation against him is general and omnibus in nature, it is also submitted that the injuries suffered by the informant is simple in nature though it is on vital part of the body but then it is not the petitioner who has assaulted.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajnagar P.S.
