Petitioner seeks bail in a case registered under sections 290, 272, 273 of the Indian Penal Code and sections 47, 53 (ga), 54 of the Bihar Excise Act.

Altogether, 57 bottles of Indian made foreign liquor were recovered from the house of the petitioner and for the aforesaid recovery, petitioner is in jail custody since 6.7.2016. There is nothing on the record to show that the petitioner was engaged in selling the aforesaid liquor and, therefore, mere possession of Indian made foreign liquor does not constitute any offence.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran
