JUSTICE RAKESH KUMAR ORAL ORDER 22-10-2016 Heard Sri Bimlesh Kumar Pandey, learned counsel for the petitioners and Sri Chaubey Jawahar, learned Additional Public Prosecutor.

Two petitioners who are in custody since 20.8.2016 in Excise Case No. 280 of 2016 registered for the offence under section 47(a) (e) of the Bihar Excise (Amendment ) Act 2016 have prayed for grant of bail.

It was submitted that on accusation of recovery of about 2 1⁄2 liters of country made liquor with liquid "Gud" petitioners have been made accused and in the said case besides the petitioners one another was also arrested. Learned counsel for the petitioners has drawn may attention to the statement made in paragraph no. 3 of the petition to show that petitioners are

Patna High Court Cr.Misc. No.46225 of 2016 (2) dt.22-10-2016 2/2 having clean antecedent.

Learned Additional Public Prosecutor has opposed the prayer for bail.

Considering the nature of accusation, period of custody and clean antecedent of the petitioners let both the petitioner Doman Dhangad and Chandan Dhangad be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah , West Champaran /concerned court in connection with Excise Case No. 280 of 2016.
