The petitioner apprehends his arrest in Sonbersa P.S. Case No. 191 of 2015 registered for offences under Section 498A and other sections of the IPC.
The informant filed complaint case and on the basis of which, the present FIR was lodged. The informant alleged that she was married to one Mubarak Darji about 20 years ago and she got five children. The petitioner happens to be distantly related brother of her husband and the petitioner offered the informant to come to his house and married with the petitioner. The informant swayed away and solemnized marriage with the petitioner. Learned counsel submits that petitioner is not the
Patna High Court Cr.Misc. No.9665 of 2017 (4) dt.18-04-2017 legally wedded husband of the informant. All the allegations are false and concocted.
Considering the nature of allegation made against the petitioner and the fact that the informant herself stated that she was married 20 years ago with Mubarak Darji and she herself left the house of her husband even though she got five children, the petitioner Md. Yunus Darji @ Md. Yunus @ Md. Inus Darji in the event of his arrest / surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
