JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with a case registered under Sections 272, 273, 290 of the Indian Penal Code and 47 of the Bihar Excise (Amendment) Act, 2016. The allegation against the petitioner is that 23 bottles of foreign liquor were recovered from his possession. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.10.2016. The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The alleged recovery is said to have been made from Public Library. Nothing is said to have been recovered from the conscious possession of the petitioner. There is no compliance of Section

On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class ,Biharsharif (Nalanda) in connection with Silao P.S.Case No. 89 of 2016.
