JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 27-07-2015 Learned counsel appearing on behalf of the petitioner submits that during the pendency of the present writ petition, the State Legislature has come with a new legislation known as Digha Acquired Land Settlement Act, 2010. He further submits that the petitioner proposes to file a fresh writ petition in the same subject matter challenging the validity of the provisions of the aforesaid Act, 2010 and also for grant of appropriate relief to the petitioner in the facts of the present case.

In above view of the matter, he seeks permission to withdraw the present writ petition with a liberty to file a fresh writ petition in the same subject matter after bringing on record all the subsequent developments, which have taken place during the interregnum period and further with a liberty to challenge the validity and correctness of the aforesaid Digha Acquired Land Settlement Act, 2010.

Permission is accorded.
