The petitioner prays for anticipatory bail in connection with Saraiya P.S. case no. 165 of 2016 registered for the offences punishable under Section 302/04 of the Indian Penal Code.

It has been submitted on behalf of petitioner that though allegation is made under Section 302 of the Indian Penal Code but there is no direct allegation against the petitioner. So far as petitioner is concerned, she is the sister of father-in-law of the deceased and not directly connected with the family. Heard learned A.P.P.

No.48237 of 2016 (2) dt.16-12-2016 2/2 Having heard both sides and considering the fact that in post mortem report, though it is reported that death is due to strangulation but the petitioner has not committed any overt act, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Saraiya P.S. case no. 165 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
