JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The application is for grant of anticipatory bail in connection with Alauli P.S. Case No. 46 of 2016, G.R. No. 383 of 2016 registered for offences under sections 147, 325, 341, 342, 498(A), 354, 494 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner. The marriage was solemnized on 15.02.2014 and the petitioner is still ready to keep his wife (informant) with full honour and dignity. It has further been submitted that earlier the informant filed a case for maintenance, vide Maintenance Case No. 61M of 2015, which was dismissed for default.

Patna High Court Cr.Misc. No.9930 of 2017 (2) dt.06-03-2017 2/2 Having heard both sides and on perusal of the impugned order it appears that the petitioner has re-married, there is allegation against the petitioner of demanding the dowry, torturing and assaulting the informant.
Considering the aforesaid aspect of the matter, this Court is not inclined to grant anticipatory bail to the petitioner, however he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit, without being prejudiced by this order. Accordingly, this petition is disposed of.
