====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-04-2019 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in R.C. case no. 219 2011 E 0004, Spl. case no. 4(E) of 2011 instituted for the offence under Section(s) 120B R/W sections 419,420, 464 and 471 of the Indian Penal Code.

A counter affidavit has been filed on behalf of the CBI which may be kept on record.

In the written report, it is alleged that original candidates have paid huge sum of money to Arun Kumar, Ajay Kumar and others to manipulate in the said examination in a manner to substitute the original candidates by dummy candidates by impersonation to appear in the said examination. Learned counsel for petitioner has submitted that from

No.22030 of 2019(2) dt.08-04-2019 2/3 para 16.39 of the charge sheet it would appear that accused Vinay Kumar Singh was caught red handed by the CBI team on 15.5.2011, while he was impersonating as Manoj Kumar Ranjan (petitioner) in All India Pr-Medical /Pre Dental Entrance Examination, 2011 (AIPMT). Learned counsel further submits that in para 16.41 it has been mentioned that investigation revealed that Vinay Kumar Singh has signed the application form of AIPMT-2011 exam as Manoj Kumar Ranjan and appeared in the AIPMT-2011 main exam and put up his signature on the attendance sheet and OMR Answer sheet of AIPMT-2011 as Manoj Kumar Ranjan. The personal particulars, postal address and photograph pasted in the application form are of Manoj Kumar Ranjan (petitioner). Learned counsel further submits that similar situated person have already been granted bail by this Hon'ble Court vide orders passed in Cr. Misc. nos. 5151 of 2019 and 4663 of 2019. Petitioner is in custody since 12.2.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CBI Judge-cum-ACJM, Patna, in connection with R.C. case no. 219 2011 E 0004, Spl. case no.
