The petitioner is aggrieved by the judgment and order dated 6th August, 2013 passed in B.L.T. Case No. 25 of 2013 by the learned Bihar Land Tribunal, Patna, as contained in Annexure6, whereby it has been directed that till pendency of Title (Partition) Suit No. 181 of 1998 between the parties, the entry made by the Circle Officer with respect to the lands in question, shall continue, but after disposal of aforesaid Title Suit No. 181 of 1998, parties will be at liberty to file a fresh application for passing the order of mutation, as per their share allotted by the civil court in the aforesaid title suit.
It is not in dispute that the petitioner as also the respondent no.5 are descendants of their common ancestor. It is also not in dispute that the aforesaid Title Suit No. 181 of 1998 is pending between the parties with respect to the lands in question. In above view of the matter, this Court does not find any
Patna High Court CWJC No.17831 of 2013 (4) dt.15-03-2016 2/2 good ground to interfere with the impugned judgment and order dated 6th August, 2013 passed by the learned Bihar Land Tribunal, Patna in B.L.T. Case No. 25 of 2013, as contained in Annexure-6 to the writ petition.
The writ petition is devoid of any merit and is, accordingly, dismissed.
