JUSTICE SATYAVRAT VERMA ORAL ORDER 03-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 498(A), 323, 504(B), 506/ 34 of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.
The learned counsel for the petitioner and the learned counsel for the informant have submitted jointly that the dispute was referred to the learned Mediator and the issue stands resolved as would have evident from the report of the learned Mediator submitted to this Court on 11.10.2022. The report of the learned Mediator dated 11.10.2022
Patna High Court CR. MISC. No.21898 of 2022(3) dt.03-11-2022 2/2 is on record and from perusal of the same, it manifests that the dispute between the parties stand resolved in terms of the agreement which is attached with the report.
Considering the submissions made by the parties, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Mahila (Darbhanga) P. S. Case No.56 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
