This is a petition for grant of regular bail for offence under Sections 458, 380, 411 and 34 of the Indian Penal Code. The first information report relates to an offence of robbery committed in the house of the informant by unknown criminals.
Submission of the petitioner is that only due to criminal records of the petitioner in the Police Station he has been implicated in this case though nothing was recovered from his possession nor there is any witness to identify the petitioner as one of the perpetrators of the crime. The impugned order would also reveal that only due to submission of the charge sheet against the petitioner bail has been refused.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kudra P.S. Case No. 107 of 2016 to the satisfaction of the Judicial Magistrate, 1st Class, Kaimur at Bhabhua, or successor Court.
