The petitioner apprehends her arrest in P.S.
Case No. instituted for the offence under sections 467, 468 and 471 of the Indian Penal Code.
Allegedly, the petitioner got issued two caste certificates and on inquiry, it was found that Karuna Kumari produced forged caste certificate of Dangi caste in the name of her sister and got elected as member of Zila Parishad. The District Magistrate enquired into the matter and the report of the District Magistrate, Gaya is part of the FIR. After holding detailed enquiry, the Collector found that the certificate produced by this petitioner, issued by Gurua, Sherghati belonging to Dangi
Patna High Court Cr.Misc. No.9232 of 2017 (2) dt.01-03-2017 community was forged.
It is submitted on behalf of the petitioner that the order of the Collector is under challenge before this Hon'ble Court bearing C.W.J.C. no. 19127 of 2016 which is still pending for final adjudication.
Since FIR has been lodged against this petitioner with allegation that she got elected as a member of Zila Parishad by producing forged caste certificates, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected at this stage.
