====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 01-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bhairabsthan P.S. Case No. 20 of 2018, instituted for the offence under Section(s) 147, 148, 149, 341, 326, 302 and 120(B) of the Indian Penal Code. In the written report it is alleged that petitioner along with co-accused Bhogendra Yadav, Binod Yadav, Sanjay Yadav and Ranjay Yadav caught hold the husband of the informant. Ranjay Yadav gave indiscriminate chhura blow causing serious injury to husband of the informant. He was taken to Sadar Hospital, Madhubani, by the villagers where Doctor declared him dead.

Counsel for the petitioner submits that Binod Yadav

Patna High Court CR. MISC. No.19589 of 2019(2) dt.01-04-2019 2/2 with similar allegation has already been granted bail by coordinate Bench of this Court vide order dated 26.10.2018 passed in Cr. Misc. 64477 of 2018.

From the written report it appears that there is specific allegation of assault against Ranjay Yadav. Petitioner is said to be brother-in-law of Binod Yadav.

Petitioner is in custody since 15.2.2019, having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Jhanjharpur (Madhubani), in connection with Bhairabsthan P.S. Case No. 20 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
