The petitioners apprehend their arrest in Nirmali P.S. Case No. 113 of 2016, registered for the offences punishable under Sections 498(A), 304(B), 201 and 34 of the Indian Penal Code.

The informant alleged that his daughter was married to Anil Kumar Sah @ Sonu Kumar in the year 2011 but Anil Kumar Sah @ Sonu Kumar and his family members were torturing his daughter. On 03.12.2016 at about 12 in the night tenant of Pramila Mahaseth @ Parmila Mahaseth Devi @ Pramila Devi, petitioner no. 1 who is mother-in-law of the deceased, informed the informant on telephone to rush to the house of his daughter as

Patna High Court Cr.Misc. No.10442 of 2017 (3) dt.11-05-2017 2/2 some untoward incident might have happened. The informant came and found the house of the petitioners locked. The police also came there and unlock the house and the dead body of the daughter of the informant was found packed in a sack under cot. Learned counsel for the petitioners submits that the petitioners are mother-in-law and brother-in-law of the deceased. No specific allegation is made against the petitioners but, from perusal of the case diary and the post-mortem report it appears that the tenant made specific allegation against the petitioners that he heard sound to save and Pramila Mahaseth @ Parmila Mahaseth Devi @ Pramila Devi, petitioner no. 1 threatened the tenant of dire consequences, if the tenant disclosed about the occurrence. The post-mortem report shows that the victim was strangulated to death.

Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
