The application is for grant of bail for the offence under Section 47 of the Bihar Excise Act, 2016. Allegation against the petitioner is of recovery of 8 litres country made liquour from the possession of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is working as Mazdoor and he has falsely been implicated in this case and he is in custody since 18.09.2016. It has further been submitted that the petitioner has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that
Patna High Court Cr.Misc. No.54978 of 2016 (2) dt.22-12-2016 2/2 the petitioner is in custody for sufficient period and he has no criminal antecedent, let petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur in connection with Sonepur (Hajipur) Rail P.S. Case No. 78 of 2016, G.R. No. 262 of 2016. (Vinod Kumar Sinha, J) Vats/- U T
