JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 22-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor assisted by learned counsel for the informant.

There happens to be specific allegation against the petitioner to have inflicted Garasa blow over head of informant Md. Afjal followed by assault by the other co-accused also. Neither there happens to be repetition of blow nor the injury assigned to the sharp cut (left) side of scalp 2" x 1⁄2" x 1⁄4" (Annexure-3) confront the same contrary to it, has been opined simple.

According, petitioner Md. Ahmad is directed to appear before the learned lower court with a prayer for bail which the learned lower court will consider favourably in the background of aforesaid finding.

Patna High Court Cr.Misc. No.50036 of 2014 (2) dt.22-04-2015 With the aforesaid observation, instant petition is disposed of.
