Petitioner, who is in custody, seeks bail in connection with Mufassil P.S. Case No. 220 of 2018 registered for the offences punishable under Sections 399, 402, 307, 353, 414 and 120(B) of the Indian Penal Code and Section 25(1b)/26/35/27 of the Arms Act. Informant has alleged that on a secret information when they reach at the place of occurrence 5 to 6 persons had assembled there to commit dacoity and on seeing police party five of them fled away and petitioner was arrested on the spot with one pistol and one cartridge.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case.

Patna High Court Cr.Misc. No.67354 of 2018(2) dt.27-11-2018 2/2 Nothing has been recovered from his possession. He has no criminal antecedent and he is in custody since 03.07.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Mufassil P.S. Case No. 220 of 2018.
