The petitioner seeks bail in Excise Case No.1346 of 2018 arising out of Barahara P.S.Case No.340 of 2018 registered for the offences under Sections 147, 148, 149, 323, 307, 221, 353, 427, 337, 338 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.
Allegation as per the F.I.R. is that the police raided the house of one Jitendra Rai who has been named in the F.I.R.and recovered 40 litres of Mahuwa wine from the hut in front of his house and thereafter mob assembled there and they started abusing the informant and got Jitendra Rai freed away. Submission on behalf of the learned counsel for the petitioner is that nothing has been recovered from possession of the petitioner and at best he can only be held as a member of
Patna High Court Cr.Misc. No.67438 of 2018(2) dt.29-11-2018 2/2 mob. He is in custody since 25.08.2018 having no criminal antecedent.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Special Judge Excise, Bhojpur at Ara, in Excise Case No.1346 of 2018 arising out of Barahara P.S. Case No.340 of 2018 subject to the condition that bailors of the petitioner shall be of local having sufficient immovable property within the jurisdiction of he court concerned.
