====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.
23-02-2017 Heard Sri Ajay Kumar, learned counsel for the petitioner.
The present petition was filed on 05-02-2016 with a prayer to restore Civil Review No. 342 of 2010, which stood dismissed due to non-compliance of peremptory order dated 01-08-2012. The review was filed after the writ petition filed by the petitioner to grant promotion/post the petitioner on the post of Basic Health Worker was rejected by a detailed reasoned order by a Bench of this Court namely Hon'ble Mr. Justice Mihir Kumar Jha, as he then was.
Ofcourse, in the present restoration petition, a plea has
Patna High Court MJC No.481 of 2016 (2) dt.23-02-2017 2/2 been taken that due to ailment of learned counsel for the petitioner, he did not appear, but no reason has been assigned as to under what circumstances at such belated stage, restoration petition was filed. No plausible explanation has been given. Accordingly, I do not find any ground to restore the review petition.
The petition stands dismissed.
