JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 The petitioner apprehends his arrest in connection with Kasba P.S.Case No. 312 of 2018 registered under Sections 379, 406 and 420 of the Indian penal Code, Section 15 of the Environment Protection Act, 1980 and Rule 40 of the Bihar Minor Mineral Concession Rules, 1972.

Allegation against the petitioner is of running brick kiln without depositing the licence fee.

Submission of learned counsel for the petitioner is that petitioner has already deposited the licence fee for the period 2017-18 and 2018-19 which will appear from page 24 to 28 of the application.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court CR. MISC. No.22280 of 2019(2) dt.08-04-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnia in connection with Kasba P.S. Case No. 312 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that if the aforesaid submission is found false, the prosecution is at liberty to move for cancellation of his bail bond before the court below itself.
