JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Bhagwanpur P.S. Case No. 166 of 2016 registered under sections 302/34 of the I.P.C. and 27 of the Arms Act pending in the Court of C.J.M., Saran at Chapra.

The allegation is of murder of the younger brother of the informant by means of fire arm injury by the petitioner and others.

Submission is that the deceased was accused in several cases and at the time of occurrence, the petitioner was not present.

Learned A.P.P. appearing on behalf of the State

Patna High Court Cr.Misc. No.51339 of 2016 (3) dt.09-02-2017 2/2 opposed the prayer of the petitioner with submission that petitioner is named in the F.I.R. and there is specific allegation against him.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
