The petitioner is accused in connection with Baisi P.S. Case No. 152 of 2016 registered under sections 273 of the I.P.C. and 47 (A) of the Bihar Excise Amendment Act. The accusation is of recovery of total 161 litres of English Wine along with 29 pieces of glass kept in a cartoon from the vehicle of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner is only a driver of the vehicle. He has no concern with the seized materials. It is also submitted that petitioner has got no criminal antecedent and is in custody since 13.09.2016.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.48902 of 2016 (3) dt.16-01-2017 2/2 case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-JudgeII-cum-A.C.J.M., Purnia in connection with Baisi P.S. Case No. 152 of 2016.
