JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 At the very outset, it is submitted by Mr. Prasoon Sinha, learned counsel for the appellant, that the appellant has died in 2010 itself as per affidavit dated 23.2.2017 filed, copy of which has been served on him by Mr. Sanjay Kumar, learned Standing Counsel for CBI, and sworn by Mr. Vikash Kumar, Inspector of Police, Delhi Special Police Establishment, CBI and, as such, learned counsel for the appellant prays for abatement of the appeal.

In the above facts and circumstances, now the appeal has become infructuous as provided in Section 394(2) of the Code of Criminal Procedure.

Hence, this appeal is abated and is dismissed as being infructuous.
