Petitioner seeks bail in a case registered under Sections-406, 420, 414, 34 of the Indian Penal Code and 47(A) of the Excise Act.

In huge quantity, pouches of country-made liquor were recovered from a Pick-up Van and two persons were caught on the spot. The name of petitioner was disclosed by co-accused Siya Shankar Pandey, who happens to be own brother of the petitioner and it appears that except the aforesaid confessional statement of co-accused, Siya Shankar Pandey and some criminal antecedent, there is nothing against the petitioner who is languishing in jail custody since 02-07-2016. Patna High Court Cr.Misc. No.37126 of 2016 (2) dt.06-09-2016 2/2 accused, Siya Shankar Pandey and Kurban Sabjifarosh have already been granted privilege of bail.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Piro P.S. Case No. 121 of 2014 to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur, Ara.
