Petitioner being the father of the daughter of the husband of the informant is languishing in custody since 01.08.2016 in a case registered for the offences punishable under Sections 364, 498A/34 of the Indian Penal Code.
The basic accusation is of torture. The specific case of the informant is that her daughter got married with the son of the petitioner Hari Shankar Sah @ Ajay Sah on 08.06.2012, thereafter torture was inflicted for non fulfillment of dowry demand. When the informant learnt about torture, he made complain to Sarpanch.
Patna High Court Cr.Misc. No.46251 of 2016 (2) dt.25-10-2016 Thereafter he also made complain in Janta Darbar of Hon'ble Chief Minister. The petitioner executed bail bonds before the Officer-in-charge, but again torture was inflicted for non-fulfillment of dowry demand. On 03.02.2016 the petitioner and others came to the house of the informant and conveyed that her daughter has went somewhere, thereafter this case was lodge. On 14.02.2016 the informant went to in-laws of his daughter, when accused persons tried to assault the informant and threatened to kill her daughter for non fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioner that victim used to run away from the Matrimonial House very often and at earlier point of time on 05.02.2016 the petitioner filed Complaint Case No. 268 of 2016, levelling accusation under Sections 379, 323, 392, 504, 120B/34 of the Indian Penal Code against the informant's family members. It is further submitted that victim has returned now. The thrust of accusation is against the husband of the victim. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri P.K. Bharti,
